Age Verification Policy

1. Our Commitments

• We require every user to confirm their age before accessing the Services.
• Where state or national law requires enhanced verification (government-issued ID, transactional-data check, or biometric liveness), we use a reputable third-party age or identity-verification vendor.
• We never retain copies of your government identification unless specifically required by law; we retain only the result of verification and an audit token.
• We apply the Restricted To Adults (“RTA”) meta label to our pages so parental-control software can filter AfterDark.ai at the device level.
• We use multiple signals (age attestation, payment identity, IP geolocation, device reputation) to deter minors and to require re-verification when anomalies are detected.

2. How Verification Works

2.1 Tier 1: Attestation & Age Gate

Every visitor encounters a prominent age gate before any adult content is displayed. To proceed, you must affirmatively confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to these Terms and our Content Guidelines.

2.2 Tier 2: Reasonable Age Verification

If you live in a U.S. state that requires “reasonable age verification” for access to sexually explicit material (for example, Texas HB 1181, Louisiana Act 440, Utah SB 287, Mississippi HB 1126, Virginia SB 1515, Montana SB 544, North Carolina HB 8, Arkansas SB 66, Idaho HB 498, Indiana SB 17, Kansas SB 394, Kentucky HB 278, Tennessee HB 1614, Florida HB 3, Georgia SB 351, South Carolina SB 439, Ohio SB 16, Oklahoma SB 1959, Alabama HB 164, Nebraska LB 1092, or any successor or analogous law), you will be routed through a trusted third-party verification vendor that uses one or more of the following methods:

• Government-issued photo ID scan with document authenticity checks.
• Biometric liveness and face-match to the ID photo.
• Commercial / transactional age-attribute check (bank / mobile-network-operator signal).
• Digital identity credential (mobile driver’s license, where available).

The verification vendor returns to us only a pass/fail result and an audit token. We do not receive or retain your government-ID image or biometric raw data, except where we are required by law to retain a specific record.

2.3 Tier 3: Ongoing Integrity Checks

We periodically re-verify age in the following circumstances: device or IP-reputation anomalies; a payment method tied to a sub-18 identity; a credible minor-access report; a law-enforcement referral; or as required by law. We may block your access until re-verification completes.

3. Data We Collect for Verification

• Your confirmation of adulthood (age-gate timestamp and IP).
• Verification vendor’s pass/fail result and transaction ID.
• Identity category used (ID, credit check, MNO, mDL).
• Optional: a hashed token tying the verification to your account for audit purposes.

4. Retention of Verification Records

Because several state laws require providers to maintain a verification record, we retain the pass/fail audit token for up to seven (7) years after your account closure, or the minimum period required by applicable law, whichever is shorter. We do not retain copies of your ID or biometric raw data absent a specific legal compulsion.

5. Parental Controls & Device Filtering

We apply the RTA meta tag (<meta name="rating" content="adult" />) across the Services. Parental-control tools that honor the RTA label, including most major operating system parental controls and reputable consumer filters, will block AfterDark.ai for supervised accounts.

6. Geographic Restrictions & Sanctions

We may block or restrict access from jurisdictions where providing the Services is illegal, where legal risk is disproportionate, or where U.S. export-control or sanctions laws prohibit providing services. Attempting to circumvent geographic restrictions (for example, by VPN) is a violation of our Terms.

7. Report a Minor on the Platform

If you believe a minor is accessing or creating content on AfterDark.ai, email safety@afterdark.ai with the account name or URL and any supporting information. We treat these reports as urgent, freeze suspected accounts pending review, and coordinate with legal authorities where appropriate.

8. Compliance & Audits

We retain vendor audit logs sufficient to demonstrate compliance with age-verification laws of the states where we operate. We reserve the right to update our verification method at any time to reflect evolving law, technology, and vendor availability.
