DMCA & Complaints

Riley Ventures LLC d/b/a Acme Studiorespects intellectual property and responds promptly to valid notices under the Digital Millennium Copyright Act (“DMCA”) and to other complaints about content on the Services. This page also covers trademark, defamation, privacy, and general trust-and-safety complaints.

1. Copyright: DMCA Takedown

If you are the owner of a copyrighted work, or an authorized agent, and you believe content on the Services infringes your copyright, you may submit a takedown notice that satisfies 17 U.S.C. § 512(c)(3) by emailing dmca@afterdark.ai or mailing our designated agent at the address above. Your notice must include:

  1. A physical or electronic signature of the copyright owner or an authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works, a representative list.
  3. Identification of the material alleged to be infringing, including the URL or story/character identifier, with sufficient specificity for us to locate it.
  4. Your contact information: full legal name, mailing address, telephone number, and email.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

2. Counter-Notice

If your content was removed and you believe removal was the result of mistake or misidentification, you may submit a counter-notice to our agent. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located (or, if outside the United States, any district in which Riley Ventures LLC may be found), and that you will accept service of process from the person who submitted the original notice or an agent of that person.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10-14 business days that it has filed an action seeking a court order against you, we may restore the removed content.

3. Repeat Infringer Policy

Consistent with 17 U.S.C. § 512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. In general, three (3) valid strikes within a rolling 12-month period will result in termination, though we may act earlier in egregious cases.

4. Trademark Complaints

If you believe content on the Services infringes your trademark or service mark, email legal@afterdark.ai with the subject “Trademark Complaint.” Include your contact information, the registration details of the mark (or proof of common-law rights), the allegedly infringing material, the basis of your complaint, and a good-faith statement that the use is not authorized.

5. Non-Consensual Intimate Imagery (NCII)

If content on the Services depicts you (or a person you are authorized to represent) in sexual or sexually suggestive conduct without consent (including digital forgeries and “deepfakes”), email ncii@afterdark.ai with the subject “NCII Takedown.” Consistent with the TAKE IT DOWN Act, we will act on a verified request within 48 hours. Include a link or story ID, a statement identifying you as the subject or authorized agent, and a good-faith statement that you did not consent to the depiction. You will not be required to submit copies of the underlying private imagery.

6. Defamation & Right of Publicity / Privacy

If content on the Services defames you, misappropriates your name or likeness, or discloses private information in violation of applicable law, email legal@afterdark.ai with the subject “Personal Rights Complaint.” Include the allegedly unlawful material, the basis of your complaint, and any supporting documentation.

7. Other Trust & Safety Complaints

For complaints that are not covered above, including child safety, hate, threats, harassment, sexual exploitation, or other policy violations, see our Safety Center or email abuse@afterdark.ai. Apparent CSAM should be reported immediately at safety@afterdark.ai; we report confirmed CSAM to the National Center for Missing & Exploited Children as required by 18 U.S.C. § 2258A.

8. How We Handle Complaints

  • We acknowledge receipt of most complaints within 3 business days.
  • We review each complaint on the merits, considering context, intent, and applicable law.
  • Outcomes include no action, labels / warnings, content restriction or removal, account suspension, or termination.
  • We notify affected parties where reasonably practicable and not prohibited by law.
  • We retain complaint records for our legal and trust-and-safety obligations per our retention schedule.

9. Appeals

To appeal a moderation decision, email complaints@afterdark.ai within thirty (30) days of the action. Appeals are reviewed by a reviewer not involved in the original decision. We aim to respond within 7 business days.
